Employers need to be aware that from 1st January 2010, the new ACAS statutory code of practice guidelines came in to effect regarding time off for union representatives.
The aim of these new guidelines is to help union representatives undertake their union duties by ensuring arrangements are made by employers to allow them to take paid time off.
The new statutory code of practices replaces an earlier code relating to the same subject.
The updated version provides further guidance for both company directors and line managers on arranging provision to manage this time off effectively with little impact on the day to day running of the organisation.
As union representatives play an important role in many organisations it is essential that they receive the appropriate amount of paid time off in accordance with the Trade Union and Labour Relations Act 1992.
The new code is expected to help organisations and union representatives to work together to achieve organisational harmony and ensure that joint responsibility is taken to manage the practical day to day issues that may arrive as a result of time off for union representatives in a fair and effective manner.
Although ignorance of the new code will not automatically lead to legal proceedings, it has been suggested that employers cannot afford to the provision made by the new code, and an understanding of the effects the new statutory code may have needs to be considered.
