Disputes between employees and employers are heard in employment tribunals. Employment Tribunals have jurisdiction to hear complaints about discrimination, unfair dismissal, and unlawful deduction of wages. However, one of the notable differences is that the successful party cannot claim their costs back from the losing party. Accordingly, ‘retaining’ the facility to defend a claim can save your business thousands of pounds.


The tribunals are similar to courts although not as formal. They have to power to make either of the parties disclose evidence and/or order witnesses attendance at the hearing. The parties give evidence in the same way as a court and people can be convicted of perjury if they lie.
